1. Acceptance of terms

By accessing and using GrabStays, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our platform.

2. Eligibility

To use GrabStays, you must meet all of the following requirements:

• A current student at a UK university or college with a valid .ac.uk email address (used for verification purposes)
• At least 18 years old (required to enter into legally binding rental agreements)
• Legally able to enter into binding contracts in the UK

Note: While .ac.uk email addresses are used to verify student status (including college students), you must be 18 or older to use GrabStays, as sublet agreements are legally binding contracts.

3. User accounts

You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Providing accurate and truthful information
• Not sharing your account with others

4. Communications and marketing

By creating an account, you agree that GrabStays may:

• Add your email address to our newsletter for promotional content, updates, and marketing communications
• Send you emails about new features, special offers, and relevant student accommodation information
• Contact you regarding your account, listings, or messages

You can unsubscribe from promotional emails at any time by clicking the unsubscribe link in any email or by updating your preferences in your account settings. Transactional emails (such as account verification, message notifications, and contract confirmations) cannot be unsubscribed from as they are essential for using the platform.

5. Listings

When creating a listing, you agree to:

• Provide accurate and complete information
• Use only photos you own or have permission to use
• Not post misleading, fraudulent, or illegal content
• Comply with all applicable laws and regulations

6. Tenancy agreements and subletting compliance

By using GrabStays to list or sublet accommodation, you acknowledge and agree that:

• You have read and understood your original tenancy agreement or lease
• Your tenancy agreement explicitly permits subletting, or you have obtained written consent from your landlord or letting agent
• You are legally authorised to sublet the property under UK law and your specific tenancy terms
• You will comply with all conditions, restrictions, and requirements set out in your tenancy agreement regarding subletting
• You understand that unauthorised subletting may constitute a breach of your tenancy agreement and could result in eviction or legal action

GrabStays is a student-only listing platform. We do not act as an agent, landlord, letting agent, property manager, or intermediary. We are not a party to any tenancy agreements, sublet arrangements, or rental contracts between users.

GrabStays accepts no liability for tenancy breaches, disputes, unauthorised sublets, eviction proceedings, financial losses, damages, or any other consequences arising from your use of the platform. You use GrabStays at your own risk and are solely responsible for ensuring that any subletting arrangement complies with your tenancy agreement and applicable law.

If you are unsure whether your tenancy agreement permits subletting, we strongly recommend that you consult your tenancy agreement, contact your landlord or letting agent, and seek independent legal advice before listing your room on GrabStays.

7. Prohibited activities

You may not:

• Use the platform for any illegal purpose
• Post false, misleading, or fraudulent listings
• Harass, abuse, or harm other users
• Spam or send unsolicited messages
• Attempt to circumvent our verification system
• Use automated systems to access the platform

8. Limitation of liability

GrabStays is a student-only listing platform that connects verified students.We are not a party to any rental agreements, sublet arrangements, or contracts between users. We do not act as an agent, landlord, letting agent, property manager, or intermediary.

To the fullest extent permitted by law, GrabStays:

• Does not guarantee the accuracy, completeness, or legality of any listing, user information, or content
• Does not verify the identity, student status, legal capacity, or authority of users to sublet properties
• Does not guarantee the conduct, reliability, or performance of any user
• Does not verify that users have permission to sublet under their tenancy agreements
• Accepts no liability for tenancy breaches, disputes, unauthorised sublets, or eviction proceedings
• Accepts no liability for financial losses, damages, personal injury, or any other harm arising from your use of the platform
• Accepts no liability for any disputes, disagreements, or legal issues between users

You use GrabStays at your own risk. All transactions, communications, and agreements between users are solely the responsibility of the parties involved. GrabStays shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Intellectual property and content ownership

Your content: You retain ownership of any content you post, upload, or submit to GrabStays, including but not limited to listing descriptions, photos, and messages. However, by posting content on GrabStays, you grant GrabStays a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of operating, promoting, and improving the platform.

GrabStays content: All content on GrabStays, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of GrabStays or its content suppliers and is protected by UK and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on GrabStays without prior written permission from GrabStays or the respective copyright owner.

10. Content moderation and reporting

GrabStays reserves the right, but not the obligation, to monitor, review, edit, or remove any content posted on the platform at any time and for any reason, including but not limited to content that:

• Violates these Terms of Service or applicable laws
• Is fraudulent, misleading, or deceptive
• Contains spam, harassment, or abusive content
• Infringes on intellectual property rights
• Is reported by other users as inappropriate

If you encounter content that violates these Terms of Service, please report it using the reporting functionality available on the platform. GrabStays will review reports in a timely manner and take appropriate action, which may include removing content, suspending or terminating accounts, or taking legal action where necessary.

GrabStays does not guarantee that all content will be reviewed or that all violations will be detected. You acknowledge that GrabStays may not monitor all content and is not responsible for user-generated content.

11. Account termination and suspension

GrabStays reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service
• Fraudulent, illegal, or harmful activity
• Providing false or misleading information
• Harassment or abuse of other users
• Circumventing or attempting to circumvent our verification system
• Any other conduct that GrabStays deems inappropriate or harmful

You may terminate your account at any time by contacting us at support@grabstays.com or by using the account deletion functionality in your account settings.

Upon termination, your right to use the platform will immediately cease. Content you have posted may remain on the platform for a reasonable period, and GrabStays may retain certain information as required by law or for legitimate business purposes. All provisions of these Terms of Service that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

12. Dispute resolution

Disputes between users: GrabStays is not involved in disputes between users. If you have a dispute with another user, you agree to resolve it directly with that user. GrabStays is not responsible for and does not mediate disputes, including but not limited to disputes regarding listings, payments, deposits, or sublet arrangements.

Disputes with GrabStays: If you have a dispute with GrabStays regarding these Terms of Service or the platform, you agree to first contact us at legal@grabstays.com to attempt to resolve the dispute informally.

If the dispute cannot be resolved informally, you agree that any disputes arising out of or relating to these Terms of Service or the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, and you agree to submit to the personal jurisdiction of such courts.

13. Platform availability and third-party services

GrabStays does not guarantee that the platform will be available at all times or that it will be free from errors, interruptions, or security vulnerabilities. The platform may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

The platform may use third-party services, including but not limited to hosting providers, email services, and analytics tools. Your use of these third-party services is subject to their respective terms of service and privacy policies. GrabStays is not responsible for the availability, accuracy, or reliability of third-party services.

GrabStays reserves the right to modify, suspend, or discontinue any aspect of the platform at any time, with or without notice, and without liability to you.

14. Changes to terms

GrabStays reserves the right to modify these Terms of Service at any time. We will notify users of material changes by:

• Posting a notice on the platform
• Sending an email to the address associated with your account
• Updating the "Last updated" date at the top of this page

Your continued use of the platform after any changes to these Terms of Service constitutes your acceptance of the modified terms. If you do not agree to the modified terms, you must stop using the platform and terminate your account.

15. Privacy and data protection

Your use of GrabStays is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the platform, you consent to the collection and use of your information as described in our Privacy Policy.

16. Governing law and jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms of Service or the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales, and you agree to submit to the personal jurisdiction of such courts.

17. Severability and entire agreement

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

These Terms of Service, together with our Privacy Policy and any other legal notices published on the platform, constitute the entire agreement between you and GrabStays regarding your use of the platform and supersede all prior or contemporaneous communications, agreements, and understandings, whether written or oral.

18. Force majeure

GrabStays shall not be liable for any failure or delay in performance under these Terms of Service that is due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, network or internet failures, or any other causes beyond our reasonable control.
